
Terms and Conditions
PART A - GENERAL TERMS

The Promoter intends to award a minimum of 4 cash grants (each a minimum of $1,000 and maximum of $5,000) (Grant) up to a maximum amount of $20,000 in total. One Grant will be provided to each of the projects which the Promoter judges, based on application forms provided by applicants, most effectively contribute to local needs and issues within the Moreton Bay Local Government Area.
Examples:
- Community skills development (excluding staff wages and salaries)
- Skills development for community workers and volunteers
- Skills development for local teachers
- Strategy and business planning for community organisations
- Community Infrastructure
- Upgrades to facilities to improve community access and use
- New infrastructure not currently existing in the community
- Purchase of equipment for use in community activities
- Community Development Projects & Activities
- Youth support
- Adult learning programs
- Community Events & Festivals
- Community skills development (excluding staff wages and salaries)

Participation in the Program constitutes acceptance of these conditions of application. Applications must comply with these conditions of application to be valid.
PART B - PROMOTER’S DETAILS

The Promoter is Stockland Development Pty Limited (ABN 71 000 064 835) of Level 4, 99 Melbourne Street, Brisbane QLD 4000 (Promoter).
PART C - WHO CAN APPLY
-
Application is open to all community-based and not-for profit organisations (including but not limited to School P&Cs, Sports Clubs, Youth organisations etc) within the Moreton bay Local Government Area.
PART D - HOW TO APPLY

Application commences on 30 January 2012 at 9am (AEST) and closes on 5 March 2012 at 9am AEST (Program Period).

To apply, applicants must, during the Program Period:
- log on to the Community Grants Program page at www.stockland.com.au/communitygrants
- download and complete the application form with all requested details.
- Upload the completed application form at www.stockland.com.au/communitygrants

Further, applicants agree that the Promoter has an unrestricted, irrevocable, transferable, divisible right and licence to use and modify their application for the purpose of the Promoter’s business without the payment of any further fee or compensation. The applicant agrees to sign any further documentation required by the Promoter to give effect to this arrangement as a precondition to being awarded the grant. To the extent permitted by law, applicants unconditionally and irrevocably consent to any act or omission that would otherwise infringe any moral rights in their application.

An application cannot be modified after it has been submitted.

Application into the Program is free (excluding internet connection charges).

The Promoter, its agents, affiliates or representatives will not be liable for any lost, late or misdirected application.

Applications must be received by 9am AEST on 5 March 2012. The time of application will in each case be the time the application is received by the Promoter’s database. The Promoter, its agents, affiliates or representatives will not be liable for any lost, late or misdirected applications including delays in the delivery due to technical disruptions, network congestion or for any other reason.

Applications not completed in accordance with these terms and conditions, and any incomplete or indecipherable applications, will be deemed invalid.
PART E - OBTAINING A GRANT

All applicants who have validly applied during the Program Period will be judged. Judging will take place at on 9 March 2012 at Level 4, 99 Melbourne St South Brisbane, Queensland.

Chance plays no part in determining the successful applicants.

Each valid application will be individually judged based on the following criteria:
- Can the organisation effectively administer the grant within 12 months?
- What will the impact of the project be in their community/area?
- Is there identified community need for the project?
- Will the project strengthen the liveability of the community?
- Are there benefits to the broader community rather than just the members of the applicant organisation?
- Does the project demonstrate long-term benefits to the community/participants?
- Is the project sustainable and will not require recurrent funding from the Promoter?

The best applications as judged by the Promoter or its representatives (Judges) will be deemed successful.

The promoter may contact applicants for clarification or any further information it deems relevant. Applicants who fail to provide this will be deemed ineligible.

The successful applicants will be notified in writing within 10 business days after the date of judging.

The Promoter’s decision in relation to any aspect of the Program is final and binding and the Promoter will not enter into any correspondence regarding the result, including in the event of a dispute.

The Promoter reserves the right, at any time, to verify the validity of entries and applicants and to disqualify any applicant who submits an application that is not in accordance with these terms and conditions or who tampers with the application process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

Should an applicant’s details change during the Program Period, it is the applicant’s responsibility to notify the Promoter. A request to access or modify any information provided in an application should be directed to the Promoter.
PART F - GRANT

There are a minimum of 4 Grants to be allocated by the Promoter as part of the Program. Each Grant is to be between $1,000 and $5,000 Australian Dollars. Each applicant must detail the amount requested in its application form.

GST will not be paid by the Promoter in addition to a Grant. If GST is payable by the applicant in performing the services or works detailed in its application, the applicant is responsible for the payment of that GST.

Each Grant must be taken as stated, and is not transferable. Applicants give the Promoter permission to communicate with them by email and/or telephone in order to provide instructions as to how each successful applicant is to claim their Grant and establish his/her entitlement to it.

The Promoter may require the successful applicant to provide the Promoter with an invoice showing the amount claimed. The successful applicant will receive their Grant within 60 days after provision of the invoice.

Independent financial advice should be sought as tax implications may arise as a result of accepting a Grant. Any taxes which may be payable by the successful applicant as a consequence of receiving the Grant are the sole responsibility of the successful applicant.

The successful applicant must ensure that the Grant is expended only as detailed in its application form.

In participating in the Program, the successful applicants agree to participate and co-operate as required in all editorial and media/PR activities relating to the Program, including but not limited to being interviewed and photographed. Each successful applicant authorises the Promoter to use such footage and photographs together with that applicant’s name, voice, video application, image and likeness for advertising and publicity purposes in any media in perpetuity worldwide without additional compensation or further reference to the successful applicant.
PART G - UNCLAIMED GRANT

Subject, where relevant, to any directions given under legislation, if a Grant is: (i) not claimed by the successful applicant within 3 months of the date of judging or (ii) forfeited for any reason, the Grant will be deemed unclaimed. The Promoter may award the grant to the applicant that the judges deemed next most worthy of the Grant. Each successful applicant of any unclaimed Grant will be notified by phone and in writing within 2 business days after the date of the unclaimed Grant.
PART I - NO LIABILITY

The Promoter and its associated agencies and companies assume no responsibility for any incorrect or inaccurate information, either caused by an applicant or due to any of the equipment or programming associated with or utilised in the Program, or for any technical error, or any combination thereof that may occur in the course of the administration of the Program including any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of nominations, and reserves the right to take any action that may be available.

If for any reason, the Program is not capable of running as planned (including but not limited to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Program), the Promoter reserves the right, in its sole discretion, to disqualify any applicant who undermines the fairness of the Program (by, for example, tampering with, or using or exploiting errors in, the application process to obtain a competitive advantage over other applicants), to take any action that may be available, and to cancel, terminate, modify or suspend the Program, subject to any direction given under state regulations, or any written directions given by a relevant regulatory authority.

The Promoter reserves the right, in its sole discretion, to disqualify any application, individual, organisation or company who the Promoter has reason to believe has breached any of these terms and conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Program. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
PART J - PRIVACY CONSENT

All applications remain the property of the Promoter. The Promoter collects personal information in order to conduct the Program, to assist in providing the products or services an applicant has requested (if any), and to improve its products and services. The Promoter or any of its related companies may use the information for promotional, marketing, publicity, research and profiling purposes. The Promoter may also share your information with other persons or entities who assist it in providing its products or services or running Programs or trade promotions (including administering the Program or trade promotion or distributing grants). The Promoter may also disclose personal information in accordance with these terms and conditions of a grantee, and as required, to Australian regulatory authorities.

The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth), and by participating in the Program, each participant is taken to consent to its privacy policy.
